The Pennsylvania attorney generals office has closed its investigation into a nightclub brawl that left two off-duty police officers injured and involved Buffalo Bills running back LeSean McCoyMcCoys Philadelphia defense attorney, Dennis Cogan, first told The Buffalo News he was informed on Thursday that the five-months-long review of the fight had been officially dropped.The Attorney General, after an independent investigation, has determined that the District Attorney did not abuse his discretion, Cogan said Friday, when reached by ESPNs John Barr.In April, Philadelphia District Attorney Seth Williams said McCoy wouldnt be charged in the incident, concluding that he couldnt prove who initiated the February fight in a Philadelphia after-hours club. Williams said at the time that its legal to act in self-defense or the defense of others. The attorney generals office subsequently decided to review Williams decision not to charge McCoy, who was one of four men originally under investigation by the D.A.Cogan said McCoy was only trying to break up a fight between the officers and his friends, who had started arguing over a $350 bottle of champagne.Frankly, McCoy did nothing wrong. He was put through hell for no reason, Cogan said.When reached Friday, Fortunato Fred Perri, one of the attorneys representing Philadelphia police officers Roland Butler and Darnell Jesse, said the Attorney Generals decision will have no impact on the Police officers pursuit of justice.Theyve suffered serious and permanent injuries as a result of the vicious beatings, Perri said of the officers, who are both back on the job.Police have said the fight broke out over a misunderstanding about who had bought the bottle of champagne.In a letter to Philadelphia Fraternal Order of Police President John McNesby, Bruce Castor, the Solicitor General of Pennsylvania in charge of the states McCoy probe, wrote:The key phrase is abuse of discretion. Whether the Attorney General agrees or disagrees with the determination of the district attorney is not the issue. I would have to not only disagree with the decision of DA Williams, but would have to conclude that his decision was so far off the mark as to be abusing the authority given him by the voters of Philadelphia. Applying that standard, I cannot say that I find DA Williams abused his discretion.The 27-year-old McCoy played for the Bills last season after six years with the Philadelphia Eagles.
